Council Decides Not to Pay Bettio for Moral Claim in Dismissed Case

All but one council member voted down a motion to pay William Bettio for costs incurred in a disorderly conduct trial that was dismissed recently in Stow Municipal Court.

Stow City Council voted 6-1 Oct. 11 against paying William Bettio fees incurred during a trial at the Stow Municipal Court that was dismissed by Judge Kim Hoover recently.

In May, the Stow Police Department charged Bettio with disorderly conduct, a fourth-degree misdemeanor. a man was blocking buses from leaving the high school by standing in front of them.

Bettio said the charge was based and hearsay.

"[The officer] never got any side of my story or any of my witnesses to what was going on that day," Bettio said at the Oct. 8 meeting. "He only took the statement from the transportation supervisor and never went to any of mine."

Bettio also told council that he, his family and daughter "have suffered continuous embarrassment after the incident at her school."

According to Law Director Brian Reali, a legal finding on whether the actions constituted a definition of "unreasonable" and "unlawful" was the reason the case was dismissed.

Reali previously said, "My file does have a statement from a witness supporting Bettio. It also has statements from a student and two bus drivers about his conduct that day."

Before council voted no on the moral claim, Bettio said, "I broke no law and the case was dismissed. I never would have fought this if I was guilty. I'm a policeman’s son and I was raised to be responsible for my actions. Every citizen has a right for fair trial."

. Councilman Brian Lowdermilk was the only "yes" vote.

Before council turned it down, Lowdermilk amended the request to pay Bettio $1,500 — which was the cost of strictly the legal fees, according to Reali. The law director said the remaining $300 was for "an inconvenience fee."

What was the reason he was blocking the buses? Just angry?

Daphne ,there was never any blocking of the any busses it was proven in a trial ,the 2 bus drivers had two totally different stories and the third wasn't even called to the trial. The student who was on bus was sent home because he would have made it worse for bus driver and officer berry smith and john daymon with his testimony. One of the bus drivers and the student could not identify the vehicle or the driver or the person suposaling stand out side of vehicle yelling at the bus driver.. For 15 min after the judge gave his judgement said he could not believe the city prosecutor and officer barry smith brought this charge to him and wasted his time because there was no facts or that any law was violated.NOT GUILTY AND WAS DISMISSED ON RULE 29 MOTION ON ACQUITTAL.look up rule 29 .

What a sad state of affairs when we waste this much time pointing fingers and passing judgement...get back to work, get back to school, suck it up and stop wasting the City's time and stop placing blame for stupid actions. The "real problem" did not "move to South Carolina"! The real problem is launching an attack on the city, the school, the bus garage and specific individuals rather than seeking proper channels to try and fix what we see as issues. What angers one person may not even matter to another. Come on, let's be more productive and even proactive about all of this, we're all dealing with things that we don't like, don't agree with, or don't understand. Get rid of the anger and move on!

@JenniGS - Wow, someone who finally makes some sense! I have been reading these stories and comments for months now along with editorials in the Stow Sentry. It seems like it's always the same individuals complaining and trying to buck the system for their own personal agendas. Especially those Bettio people! I am glad city council stood up to him and did not pay his legal fees. Why not be a man, pay the ticket and move on - everyone seems to know you deserved what was coming to you - you seem to be nothing but an angry, miserable hot head!
